Restraining Order Trials in New Jersey
Restraining order hearings — whether a Temporary Restraining Order (TRO) or Final Restraining Order (FRO) trial under the Prevention of Domestic Violence Act — are among the most consequential proceedings in New Jersey Family Court. An FRO is permanent and carries serious collateral consequences, including firearms restrictions, employment impacts, and a permanent public record.
We represent both plaintiffs seeking protection and defendants contesting restraining orders. Our approach is the same in both roles: thorough preparation, careful witness examination, and a clear legal strategy built around the two-part test established in Silver v. Silver and its progeny.
The plaintiff must prove by a preponderance of the evidence that the defendant committed a predicate act of domestic violence as defined under N.J.S.A. 2C:25-19 — such as assault, harassment, stalking, criminal mischief, or terroristic threats.
The court must find that a restraining order is necessary to protect the plaintiff from immediate danger or further acts of domestic violence. This is a fact-sensitive inquiry that our attorneys are trained to address on both sides.
