A custody order entered at the time of divorce or separation is not carved in stone. New Jersey courts recognize that children's needs and family circumstances change over time, and the law provides a mechanism for modifying custody when those changes are significant enough to warrant it.
The Substantial Change in Circumstances Standard
To obtain a modification of a custody order, the moving party must first demonstrate a "substantial change in circumstances" since the entry of the original order. This threshold requirement exists to prevent parties from relitigating custody every time they disagree with a parenting decision.
What constitutes a substantial change in circumstances? Courts have recognized the following:
- Relocation — A parent's desire to move out of state with the child is one of the most common and complex modification scenarios
- Domestic violence or abuse — Documented abuse of the child or the other parent
- Substance abuse — A parent's new or worsening substance abuse problem
- Significant change in the child's needs — A child's developmental, educational, or medical needs that the current arrangement cannot meet
- A parent's significant change in work schedule — Making the existing parenting time arrangement impractical
- The child's own wishes — As children mature, their expressed preferences carry increasing weight
- Alienation — A parent's deliberate interference with the child's relationship with the other parent
Best Interests of the Child: The Ultimate Standard
Once a substantial change in circumstances is established, the court conducts a full best-interests analysis under N.J.S.A. 9:2-4. The factors include:
- The parents' ability to agree, communicate, and cooperate in matters relating to the child
- The parents' willingness to accept custody and any history of unwillingness to allow parenting time
- The interaction and relationship of the child with its parents and siblings
- The history of domestic violence, if any
- The safety of the child and the safety of either parent from physical abuse by the other parent
- The preference of the child when of sufficient age and capacity to reason
- The needs of the child
- The stability of the home environment offered
- The quality and continuity of the child's education
- The fitness of the parents
- The geographical proximity of the parents' homes
- The extent and quality of the time spent with the child prior to or subsequent to the separation
Relocation Cases
When a custodial parent seeks to relocate out of New Jersey with the child, the analysis is governed by Bisbing v. Bisbing (2017), which eliminated the prior presumption in favor of the custodial parent's relocation and requires a full best-interests analysis in all cases. Relocation cases are among the most complex and emotionally charged custody disputes, and experienced legal representation is essential.
