Family law matters are among the most personal and consequential legal proceedings a person can face. Whether you are navigating a divorce, fighting for custody of your children, seeking protection from domestic violence, or defending against a restraining order, the decisions made in Family Court will shape your life for years to come. Ibrahim Ahmed Law Group, P.C. brings the same litigation-focused preparation to family law that we bring to every courtroom.
Domestic Violence & Restraining Orders (TRO / FRO)
Domestic violence proceedings in New Jersey Family Court are among the most time-sensitive matters in the legal system. A TRO can be issued the same day it is applied for, and an FRO hearing is typically scheduled within 10 days. The FRO is permanent and carries serious consequences. We represent both plaintiffs seeking protection and defendants contesting restraining orders. Our attorneys are experienced in the two-part test under Silver v. Silver and the evidentiary standards that govern these proceedings.
- TRO applications — emergency same-day filings
- FRO final hearing trials (plaintiff and defendant)
- Defendant representation — contesting restraining orders
- Modification and dissolution of Final Restraining Orders
- Contempt proceedings for FRO violations
- Civil restraints in non-domestic harassment matters
Divorce & Separation
New Jersey is a no-fault divorce state, meaning either party can file based on irreconcilable differences without proving fault. We handle both contested and uncontested divorces, with a focus on protecting our clients' financial interests and parental rights.
- No-fault and fault-based divorce proceedings
- Equitable distribution of marital assets and debts
- Alimony (open durational, limited duration, rehabilitative)
- Separation agreements and marital settlement agreements
- Post-divorce modification motions
Child Custody & Support
New Jersey courts determine custody based on the best interests of the child under N.J.S.A. 9:2-4. Child support is calculated using the Income Shares Model. We advocate aggressively for parenting arrangements that serve our clients' children while protecting their parental rights.
- Sole and joint legal custody arrangements
- Primary and shared physical custody
- Parenting time schedules and holiday arrangements
- Relocation applications (Baures standard)
- Child support calculation and modification
- Emergency custody applications
Frequently Asked Questions
What is the difference between a TRO and an FRO in NJ?
A Temporary Restraining Order (TRO) is an emergency order issued ex parte (without the other party present) that provides immediate protection. It is temporary — an FRO hearing is scheduled within 10 days. A Final Restraining Order (FRO) is issued after a full hearing where both parties present evidence. An FRO is permanent and does not expire unless dissolved by the court.
How is property divided in a New Jersey divorce?
New Jersey follows equitable distribution — marital property is divided fairly, but not necessarily 50/50. Courts consider the length of the marriage, each spouse's income and earning capacity, contributions to the marriage, tax consequences, and the standard of living established during the marriage. Separate property (owned before marriage or received as a gift or inheritance) is generally not subject to division.
Can I modify a custody order after it is entered?
Yes. A custody order can be modified upon a showing of a substantial change in circumstances since the original order was entered. Courts apply the best interests of the child standard in any modification proceeding.
How long does it take to get a divorce in New Jersey?
An uncontested divorce can be finalized in as little as 3–6 months. A contested divorce involving custody or significant assets can take 1–3 years. The timeline depends on the complexity of the issues and the parties' ability to reach agreement.
