Expungement in New Jersey: Who Qualifies and How to Clear Your Record

What Is Expungement?

Expungement is the legal process of sealing and isolating criminal records so they are not accessible to the public or most employers. In New Jersey, an expunged record is treated as if the arrest, charge, or conviction never occurred — you can legally answer "no" when asked on most job applications whether you have been arrested or convicted.

New Jersey's Clean Slate Law (2020)

In 2020, New Jersey enacted the Clean Slate Law, which significantly expanded expungement eligibility and created an automatic expungement process for certain offenses. Key changes include:

  • Automatic expungement: Individuals who have been conviction-free for 10 years may be eligible for automatic expungement of most convictions
  • Expanded eligibility: More offenses are now expungeable
  • Reduced waiting periods: The waiting period for many offenses was reduced

Who Qualifies for Expungement?

Indictable Convictions (Felonies)

  • Waiting period: 6 years from conviction, payment of fines, or completion of probation/parole (whichever is later)
  • Maximum: One indictable conviction (with exceptions for multiple convictions arising from the same transaction)
  • Disqualifying offenses: Murder, robbery, sexual assault, kidnapping, and other serious crimes cannot be expunged

Disorderly Persons Offenses (Misdemeanors)

  • Waiting period: 5 years
  • Maximum: Up to three disorderly persons convictions

Municipal Ordinance Violations

  • Waiting period: 2 years

Arrests Without Conviction (Dismissals, Acquittals, No Bills)

  • Can be expunged immediately after the case is resolved
  • No waiting period required

PTI (Pretrial Intervention) Dismissals

  • Waiting period: 6 months after successful completion

Drug Offenses

  • Many drug offenses are now expungeable under the Clean Slate Law
  • Marijuana-related offenses have special provisions under NJ's marijuana legalization law

Offenses That Cannot Be Expunged

  • Murder, manslaughter, kidnapping
  • Sexual assault and related offenses
  • Robbery
  • Arson
  • Child abuse and endangerment
  • Human trafficking
  • Most offenses involving public officials in connection with their duties

The Expungement Process

  1. Obtain your criminal history from the NJ State Police
  2. Prepare the petition — a formal legal document listing all arrests and convictions
  3. File the petition in the Superior Court in the county of conviction
  4. Serve all required agencies — State Police, county prosecutor, municipal court, etc.
  5. Attend the hearing (if scheduled — many are granted without a hearing)
  6. Receive the Order of Expungement and serve it on all agencies

Benefits of Expungement

  • Answer "no" on most private employer job applications
  • Restored eligibility for certain professional licenses
  • Improved housing opportunities
  • Peace of mind

Important limitations: Expunged records may still be accessible to law enforcement, certain government agencies, and in subsequent criminal proceedings.
